Terms of Use
These terms are the agreement between you and Nightale ("we", "us") for using the Nightale app, its stories and this website. By installing or using the app you accept them. If you do not agree, please do not use Nightale.
1. What Nightale is
Nightale is an audio app that tells true stories from history, written and narrated to be listened to at bedtime. Some stories are free. The full library, offline downloads and the ambient sound mixer are part of Nightale Premium, a subscription.
2. Your account
Nightale creates an anonymous account on your device. You are responsible for the device it lives on. If you share a device, anyone who uses it can use your Nightale. See the Privacy Policy for what that account holds.
3. Nightale Premium
Plans. Annual at $35 per year, or Monthly at $6.99 per month, in US dollars. Prices in other currencies are shown in the store before you buy and may change.
Free trial. New subscribers get 7 nights free. If you do nothing, the paid plan you chose starts automatically when the trial ends and you are charged then.
Renewal. Subscriptions renew automatically at the end of each period until you cancel. Payment is charged to your Apple or Google account no earlier than 24 hours before the end of the current period.
Cancelling. On iPhone: Settings › your name › Subscriptions. On Android: Google Play › Subscriptions. Cancel at least 24 hours before the period ends to avoid the next charge. Deleting the app does not cancel a subscription. You keep Premium until the end of the period you paid for.
Refunds. Purchases are handled by Apple or Google under their refund rules. To ask for a refund, use Report a Problem at reportaproblem.apple.com or Google Play's order history. We cannot issue refunds ourselves.
Restoring. If you reinstall or change devices, tap Restore Purchases in the app while signed in to the same Apple or Google account.
4. Using the stories
We grant you a personal, non-transferable licence to stream and, with Premium, download stories for your own private listening. You may not copy, redistribute, resell, publicly perform, broadcast or extract the audio, artwork or text, or use them to train software, without our written permission. Downloads are for use inside the app and stop working if your subscription ends.
5. Accuracy and health
Our stories are researched with care, but history is contested and we simplify it for sleep. Nightale is not an academic source. It is also not a medical product: it is not intended to diagnose or treat insomnia or any other condition. If you have persistent trouble sleeping, please talk to a doctor.
6. Your responsibilities
- Use Nightale only as these terms and the app stores allow.
- Do not try to bypass the subscription, tamper with the app, or interfere with our servers.
- Do not listen while driving or doing anything that needs you awake.
7. Changes to Nightale
We add stories every week and occasionally retire or re-edit them. We may change features, prices for future periods, or these terms. Price changes are announced through the store and apply only after you have had the chance to cancel. Continued use after a change means you accept it.
8. Ending the agreement
You can stop at any time by deleting the app and cancelling any subscription. We may suspend or end access if you break these terms or if we discontinue the service, in which case any prepaid period is handled under the store's refund rules.
9. Liability
Nightale is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, for the app being unavailable, or for anything that happens because you fell asleep. Nothing in these terms limits rights that consumer law gives you and that cannot be excluded.
10. Apple and Google
If you got Nightale from the App Store, Apple is not a party to these terms, has no obligation to provide support or maintenance, and is a third-party beneficiary entitled to enforce them. The same applies to Google for Google Play. Their own terms of service also apply to your use of the store.
